01
What these terms cover
These proposed terms cover the OptiTalent website and recruiting tools. Product-specific agreements, order terms and software licences may also apply to the service you select. A local design preview is not an account, subscription or live recruiting service.
OptiTalent provides software, not an employment agency acting on every listed role. The organisation publishing a job is responsible for the vacancy, its communications and its hiring decisions. An application receipt is not a job offer or a promise of a response.
02
Accounts and authorised use
Use only accounts, workspaces and records you are authorised to access. If you act for an organisation, you must have authority to do so. Protect sign-in credentials and provider keys, review member access, and promptly raise suspected unauthorised use through a verified support channel.
Do not bypass access controls, test other customers' accounts, distribute malicious files, impersonate a candidate or employer, publish deceptive jobs, or use the service for unlawful discrimination or unsolicited bulk messages.
03
Your records and other people's information
You retain any rights you hold in the material you provide. Using recruiting software does not remove a candidate's privacy rights or give you ownership of another person's identity or work. Only provide and share information you are entitled to use for the stated recruiting purpose.
The service needs permission to process submitted material to perform the actions you request. That permission is not a general licence to publish a private database. You remain responsible for source permissions, candidate notices, accuracy and lawful disclosure to clients or other recipients.
04
Free plans and paid services
Free refers to the OptiTalent plan described on the applicable pricing page, not unlimited computing, storage or third-party services. Feature availability, limits and paid options must be clear before you activate a chargeable service. The public website does not take a paid order unless a checkout is expressly presented.
When you bring your own AI connection, your provider's agreement and charges apply separately. A Custom engagement needs an agreed scope and price. A roadmap, design example or planned integration is not a commitment to a release date or included entitlement.
05
AI and recruiting decisions
Generated summaries and matching suggestions can be incomplete, inaccurate or unsuitable for a particular role. Check the underlying sources, consider missing evidence and correct errors before relying on an output or sharing it.
You remain responsible for decisions and external actions, including contacting, rejecting, shortlisting or publishing information about a candidate. A ranking is not a prediction of someone's worth, a legal assessment or a guarantee of hiring success.
06
Sharing and third-party services
Before sending a shortlist or exporting records, check the recipient and the information included. Revoking a link cannot retrieve information a recipient has already copied. An expiring link does not delete the underlying recruiting record.
Third-party sites, AI providers and independently operated deployments have their own conditions and security practices. OptiTalent does not grant permission to scrape a platform, evade its restrictions or use another party's data without authority.
07
Availability, ending use and your rights
Software and network services may be interrupted. Keep appropriate backups and review export options for your selected deployment before relying on it. Restricted or experimental features may change and should not be treated as a service-level commitment.
Nothing in these proposed terms excludes rights or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees. Stopping use does not by itself resolve outstanding payment obligations or delete records held by a recruiting organisation. Cancellation, retention and any paid-service commitments must follow the applicable service agreement.
08
Questions and changes
The final contracting entity, public contact channel and effective date must be confirmed before these terms are offered for acceptance. This edition is a review draft dated 8 September 2026, not a retroactive change to an existing agreement.
The sample shortlist is fictional and does not create an account, take payment or accept a binding order. A published job application is different: submitting its form sends the disclosed information to the named recruiting organisation.
